Terms and conditions

This is a legal agreement between you, the end user (hereinafter 'the Member'), and Police and Customs Bank (ABN 95 087 650 799) (AFSL/Australian Credit Licence No. 240018) of 25 Pelican Street, SURRY HILLS NSW 2010 (hereinafter 'the Bank').

1. General terms and conditions.

 

1.1 The www.policebank.com.au / www.customsbank.com.au Web site ("this Web site") is owned by the Bank. It is operated by the Bank and other companies, contracted to the Bank, who supply specific functionality to the site. Delivery of statements via the Internet and associated functions are provided by such a contracted company, a specialist electronic Billing Service Provider (hereinafter "the BSP").

 

1.2 Your access to this Web site and services provided through this Web site is subject to these terms and conditions, the Bank Privacy Statement, notices, disclaimers any other terms and conditions or other statements contained on this Web site, and, if you use any of the services identified on this Web site for which additional or alternative terms and conditions are referred to, those additional terms and conditions for those other services (referred to collectively as "Terms and Conditions of Use"). By accessing, viewing or otherwise using this Web site, you agree to be subject to these Terms and Conditions of Use.

 

1.3 Bank may, at its sole discretion, vary or modify these Terms of Use without notice. Any subsequent access to, or use by you of the Web site will constitute an acceptance of those modifications.

 

1.4 You agree that where the Bank is required, by law or otherwise, to provide you with a document, you consent to the provision of that document electronically through the links on this Web site. Documents so provided are in a format suitable for local printing or filing. We suggest that you print a copy of each such document, or file it electronically, for future reference.

 

1.5 Products and services referred to on this Web site are only available in Australia.

 

1.6 The Bank may email you marketing material from time to time to your registered email address. You may opt-out of receiving marketing materials at any time by contacting 131 728.

3.2 Documents delivered to you via hyperlinks on the Web site may be printed, copied, transmitted to other persons, filed or otherwise used by you without limitation.

4. Your responsibilities

 

4.1 We rely on you to provide information, such as your email address, to enable us to deliver documents to you electronically. You agree to provide such information accurately and to keep this information up to date.

 

4.2 You agree that you will keep confidential any and all IDs and passwords issued to you and/or selected by you in relation to the use of the Web site.

 

4.3 You agree you will report any apparent problems or malfunctions with the Web site to us promptly. Reports should be made by phone on 131 728 and/or email details to info@policebank.com.au or info@customsbank.com.au for Bank support.

5. Delivery

 

5.1 A document will be deemed to be delivered to you electronically when either:
a) It is sent by email to the email address last advised by you to the Bank, and no transmission error message is received by the dispatching mail server within 12 hours of dispatch of the email message; or
b) An email message informing you that a document is available for viewing through the Web site is sent by email to the email address last advised by you to the Bank, and no transmission error message is received by the dispatching mail server within 12 hours of dispatch of the email message.

 

5.2 In the event of 5.1(b), you agree that failure by you to access the Web site and view the document within 30 days of dispatch of the informatory email message does not constitute non-delivery on our part.

6. Alternative means of delivery

 

6.1 If the Bank or BSP is unable to deliver any document or documents to you electronically, using the information you have supplied, then we reserve the right to print any such documents and send them to you via the postal service. Wherever possible, we will include with any printed documents information about the cause(s) of each failure of electronic delivery, and recommend actions you might take to correct such cause(s).

 

6.2 You agree that, in the event of any failure of the electronic statement delivery service, you will take promptly any and all actions recommended under 5.1.

 

6.3 If the Bank, at its sole discretion, determines that a cause of failure of an electronic delivery is the fault of the Member, then the Bank reserves the right to charge the Member a fee for provision of printed documents in lieu of electronic documents. Any such fee will be advised in advance in the normal way in which fee information is announced.

7. Consumer Credit Code Statements

 

7.1 If you agree to receive electronic statements, we are no longer required to send you a paper version of your statement.You should check your email regularly for notices from us; and keep your email address up to date.You may withdraw your consent at any time by written notice to the Bank.

 

7.2 You will be able to print out or download your electronic statement from the Bank's website.

 

7.3 By clicking on the 'accept' button immediately below, you give specific positive election in writing to receive your loan account statements (as well as other Statements such as your deposit account statements) by electronic means.
